Charlie Kirk Murder Case: Suspect Faces Preliminary Hearing in Utah

The family of conservative activist and Turning Point USA founder Charlie Kirk came face-to-face Monday with the man accused of his murder as a preliminary hearing got underway in Utah County, where prosecutors are seeking the death penalty against suspect Tyler Robinson, 23.

Shooting That Shocked the Country

Kirk, 31, was fatally shot on September 10, 2025, while speaking under a tent at Utah Valley University in Orem, Utah, as part of his American Comeback tour of college campuses — a series of events in which he invited attendees to debate him publicly. A shot rang out around 12:20 p.m. as Kirk was speaking about gun violence. He slumped to the side and died from his injuries.

Authorities announced Robinson’s arrest two days later. He has been charged with aggravated murder, felony discharge of a firearm, obstructing justice, and witness tampering. Robinson has not yet entered a plea.

Kirk’s Family Issues Statement, Arrives at Courthouse

Kirk’s widow, Erika, his parents Robert and Kathryn, and his sister Mary released a joint statement ahead of Monday’s proceedings, which are scheduled to continue through Friday. “Charlie was a beloved husband, son, brother, friend, and father,” the statement read. “Every court proceeding serves as a painful reminder of his death and the loss that has irrevocably impacted our lives and the lives of his children.”

The family asked for privacy as they navigate the judicial process. “Out of respect for the judicial process, we will not be commenting further at this time,” the statement said. Kirk’s parents and widow arrived at the courthouse separately on Monday. Robinson, dressed in a light-colored suit, sat between his attorneys at the defense table.

Sniper Evidence Detailed in Court

Prosecutors opened with testimony from law enforcement witnesses, with four officers expected to take the stand during the day. One officer testified about the chaotic scene that unfolded immediately after the shooting, describing people shouting and running as the situation developed.

The officer said he found a screwdriver on a rooftop and what appeared to be an impression in the gravel consistent with a sniper’s prone position. “I could see the disturbance of gravel; to me, it looks like a sniper pad — a person that has been laying in a prone position, and you’ve got markings of elbows, knees and feet, where somebody was in the line of sight of where Charlie’s tent was,” he testified. Security footage reviewed at the scene showed an individual dropping down from the rooftop and fleeing the area.

The officer said that after reviewing the evidence, he came to believe the initial person taken into custody may not have been the correct suspect.

Defense Seeks to Exclude Evidence, Block Death Penalty

Defense attorneys have sought throughout earlier proceedings to exclude certain evidence and unsuccessfully attempted to bar cameras from the courtroom during the preliminary hearing. They have also asked Judge Tony Graf to remove the death penalty as a possible sentence. Defense attorney Kathryn Nestor raised repeated objections during Monday’s questioning of the prosecution’s witnesses and will have opportunities to cross-examine officers later in the hearing.
